General Terms and Conditions

    1. Scope

      The following terms and conditions apply to all orders (e.g. individual purchases or subscription contracts) placed via our online shop. Our online shop is aimed exclusively at consumers. Any terms and conditions of the customer are hereby rejected.

      A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

        2. Contracting Party, Conclusion of Contract, Correction Options, Customer Account

          The purchase contract is concluded with Pura AG, Rütistrasse 16, 8952 Schlieren, Switzerland. Authorised representative: Tim Sellmann. 

          By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. If a subscription is included, you must also agree to our cancellation policy. Immediately after submitting your order, you will receive another confirmation by email.

          A customer account is required to conclude the contract. For the security of your customer data, please refer to our privacy policy. Creating a user account is free of charge. You undertake to provide truthfully all personal data required to create the user account. You also undertake to keep your data up to date and truthful at all times. If Pura AG believes that your data is not truthful, Pura AG may temporarily block access to your user account or delete it completely.

            3. Contract Language, Storage of the Contract Text

              The language available for concluding the contract is German.

              We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

                4. Payment

                  The following payment methods are generally available in our shop:

                  During the ordering process, you will be redirected to the website of the online provider (e.g. PayPal). To pay the invoice amount via PayPal, you must be registered there or register first, verify your identity with your login details and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is then carried out automatically by PayPal immediately afterwards. You will receive further information during the ordering process.

                  Please note the terms and conditions applicable from 11 January 2022 if you order with Klarna "Pay by invoice" from the Netherlands or Belgium - customers who use "Pay by invoice" must settle the payment within 30 days.

                  Please note that we only accept credit cards or PayPal for subscriptions. Purchase on invoice is not possible for subscriptions.

                    5. Transport Damage

                      If goods are delivered with obvious transport damage, please report such faults to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

                        6. Warranty and Guarantees

                          The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with each product and on special information pages in the online shop.

                            7. Right of Withdrawal

                              The right of withdrawal is described separately.

                                8. Liability

                                  For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation

                                  • in the event of injury to life, body or health
                                  • in the event of intentional or grossly negligent breach of duty
                                  • in the case of guarantee promises, where agreed, or
                                  • where the scope of the Product Liability Act applies.

                                  In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on whose observance the contracting party may regularly rely (cardinal obligations), caused by slight negligence on the part of us, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

                                        10 Dispute Resolution

                                          The European Commission provides a platform for online dispute resolution (ODR), which you can find here . We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
